Notably, California law establishes a person is driving under the influence "if, as a result of drinking or consuming an alcoholic beverage and/or taking a drug, their mental or physical abilities are impaired to the extent that they are no longer able to drive a vehicle with the caution of a sober person, using ordinary care, under similar circumstances."

Additionally, if a California police officer, sheriff's deputy or highway patrol officer suspects a person has driven under the influence and that person is determined to have a blood alcohol concentration (BAC) of 0.08% or higher, they face a possible jail sentence, large fines, driver's license suspension and other very serious consequences. In fact, a law enforcement officer is required to seize any California driver's license of a person arrested for driving with a blood alcohol concentration of 0.08% or greater.
